New York Traffic Tickets

As a New York Traffic lawyer, I have handled thousands of New York State traffic tickets. While the majority of tickets handed out by the police are speeding tickets, over the years I have handled virtually every type of traffic ticket including driving with a suspended license, reckless driving, crossing over hazard markings, HOV violations, unsafe lane change, failing to signal, passing a stop sign, red light violations, passing a school bus, revoked registration, speeding tickets, trucking violations, driving while intoxicated, driving while ability impaired due to drugs and tickets for no insurance.

If you have received a traffic ticket, it is best to retain an attorney who concentrates in that area of law. As a New York Traffic Lawyer, I am familiar with the nuances of each of the courts that I appear before. As a traffic attorney I will attempt to have the ticket dismissed. When a dismissal is not possible, I will attempt to negotiate a resolution to a reduced charge. Of the thousands of traffic tickets that I have handled over the years, almost all were reduced or dismissed.

There are advantages to retaining a Traffic Attorney early on.

Even though I am often retained just before the court date (at times even on the same day as the court date) there are advantages to hiring a Traffic Lawyer early in the process. In some courts, with certain tickets, when I am retained prior to the first court date (the date listed on the bottom the ticket), there is an opportunity to get the tickets dismissed. There is a window of opportunity on certain tickets to request documents from the court/police.  In some courts, the request must be made on or before to the court date listed on the bottom of the ticket. In other courts the demand must be made within 30 days of the return date listed on the ticket. If the request is made after that date, you may have missed an opportunity. Often depending on the response, or lack of a response, a motion will be filed with the court seeking the outright dismissal of the tickets.

New York Traffic Ticket Update

Cell phone tickets which were 0 points a few years ago, then increased to 2 points, are now 3 points. Many people don’t realize that tickets for failing to use a hands free device ( VTL 1225-c)  now carries the same amount of points as a ticket for crossing hazard markings, failing to yield, passing a stop sign, or going through a red light.

A new addition to the New York State Vehicle and Traffic law is VTL 1144-a. Known as the move over law, it requires motorist to move over or slow down when passing emergency vehicles that are stopped on the side of the road. A conviction for this violation carries 2 points. I have seen a lot of these tickets lately.

Another new addition to the New York State Vehicle and Traffic Law is a violation known as use of portable electronic device ( VTL 1225-d). The new law prohibits the use of portable electronic devices, such as cell phones and smart phones, to send text messages or emails while driving. A conviction for this carries 3 points.
